1. הסכמה לתנאים

בהורדה, התקנה, או שימוש באפליקציית Calmino ("האפליקציה" / "השירות"), הנך מסכים לתנאי שימוש אלה ("התנאים"). אם אינך מסכים, הפסק את השימוש לאלתר ומחק את האפליקציה.

תנאים אלה מהווים הסכם משפטי מחייב בינך לבין Calmino. השימוש באפליקציה מהווה אישור שקראת, הבנת ומסכים לכל התנאים המפורטים להלן.

2. תיאור השירות

Calmino היא אפליקציית מעקב ובריאות לתינוקות וילדים, המאפשרת:

• מעקב אחר האכלה, שינה, חיתולים, תוספי תזונה, חיסונים ותרופות
• מדידת מדדי גדילה ועקומות צמיחה
• שיתוף נתונים עם בני / בנות משפחה
• יצירת סטטיסטיקות, דוחות ותובנות
• תיעוד רגעים קסומים ואבני דרך
• ניהול תזכורות והתראות מותאמות אישית

הגיל המינימלי לשימוש: 16. השירות אינו מיועד למשתמשים מתחת לגיל 16.

3. חשבון משתמש

• רישום: עליך לספק פרטים אמיתיים, מדויקים ועדכניים.
• אבטחה: אתה אחראי לשמירת סודיות סיסמתך ואמצעי הכניסה לחשבונך. הודע לנו מיד על כל שימוש לא מורשה.
• חשבון יחיד: כל אדם רשאי להחזיק חשבון אישי אחד בלבד.
• אחריות: אתה האחראי הבלעדי לכל פעילות שמתבצעת בחשבונך.
• מחיקה: תוכל למחוק את חשבונך בכל עת דרך מסך ההגדרות.

4. שימוש מותר ואסור

מותר:

• שימוש אישי ומשפחתי לניהול טיפול בילדיך
• שיתוף נתונים עם בני / בנות משפחה

אסור בהחלט:

• שימוש מסחרי ללא רישיון כתוב מאתנו
• העלאת תוכן בלתי חוקי, פוגעני, מטעה, או מפר זכויות
• ניסיון לגשת לנתוני משתמשים אחרים ללא אישור
• הנדסה לאחור, פירוק, או שכפול הקוד של האפליקציה
• שימוש בבוטים, סקריפטים, או כלים אוטומטיים
• הפצת ספאם, malware, או תוכן זדוני
• שימוש לעקיבה, הטרדה, או פגיעה בפרטיות אחרים

5. תוכן המשתמש

המידע שתזין לאפליקציה (תמונות, הערות, רשומות) נשאר שלך. על ידי העלאתו, אתה מעניק לנו רישיון מוגבל, לא בלעדי, לאחסן, לגבות ולהציג אותו לצורכי מתן השירות בלבד.

אתה מתחייב שהתוכן שתעלה: אינו מפר זכויות יוצרים או קניין רוחני; אינו בלתי חוקי, פוגעני, או מטעה; ואינו מכיל מידע רגיש של אחרים ללא הסכמתם.

6. שירות פרמיום

• Calmino מציעה תוכניות מנוי בתשלום ("פרמיום") עם תכונות מורחבות.
• תשלומים מעובדים דרך Apple App Store או Google Play Store בלבד — Calmino אינה מחזיקה את פרטי כרטיס האשראי שלך.
• מנויים מתחדשים אוטומטית בתום כל תקופה; ניתן לבטל בכל עת דרך הגדרות החנות.
• לא יינתנו החזרים כספיים לתקופות שבהן בוצע שימוש, אלא אם נדרש על פי חוק.
• שמורה לנו הזכות לשנות תמחור עם הודעה מוקדמת של 30 יום.

7. שירותים של צדדים שלישיים

האפליקציה מסתמכת על שירותים חיצוניים:

• תשתית, אחסון נתונים ואימות משתמשים (Google Firebase)
• אימות ומערכת התראות (Apple)
• פלטפורמת פיתוח ועדכונים (Expo / EAS)
• ניהול מנויים ורכישות מאובטח (RevenueCat)
• שירות נתוני מזג אוויר (Apple WeatherKit)

שימושך בשירותים אלה כפוף גם למדיניות ותנאי השימוש שלהם. Calmino אינה אחראית לזמינות, ביצועים, או שינויים בשירותי צד שלישי.

8. הגבלת אחריות ואחריות רפואית

• השירות מסופק "כפי שהוא" (AS IS) ו-"כפי שהוא זמין" (AS AVAILABLE) ללא אחריות מכל סוג.
• האפליקציה אינה מחליפה ייעוץ רפואי מקצועי. המידע המוצג הוא לצרכי תיעוד ומעקב בלבד. תמיד התייעץ עם רופא ילדים מוסמך בכל שאלה רפואית.
• Calmino אינה נושאת באחריות לנזקים ישירים, עקיפים, נסיבתיים, מיוחדים, עונשיים, או תוצאתיים הנובעים משימוש באפליקציה.
• אחריותנו הכוללת לא תעלה על הסכום שאתה שילמת בשנת הרישום האחרונה, או 200 ₪ — הנמוך מביניהם.

9. קניין רוחני

כל הזכויות באפליקציה — לרבות קוד מקור, עיצוב, ממשק משתמש, לוגו, שם "Calmino", וכל תוכן שיצרנו — הינן קניינה הבלעדי של Calmino ומוגנות בחוק זכויות יוצרים, סימני מסחר ופטנטים.

חל איסור מוחלט על שכפול, הפצה, שינוי, יצירת נגזרות, הצגה ציבורית, או שימוש מסחרי — ללא אישור מפורש בכתב. הפרה תגרור תביעות אזרחיות ו/או פליליות.

10. ביטול חשבון והשעיה

שמורה לנו הזכות להשעות או לסגור חשבון שהפר את התנאים, עם הודעה מוקדמת במידת האפשר. בסגירה מרצון: תוכל לייצא את נתוניך לפני המחיקה הסופית באמצעות כפתור "הורד את המידע שלי" בהגדרות.

11. פיצוי

הנך מסכים לשפות ולהגן על Calmino, עובדיה, מנהליה, בעלי מניותיה ושותפיה מפני כל תביעה, נזק, אחריות, הפסד, עלות ושכר טרחת עורך דין הנובעים משימושך בשירות, הפרת תנאים אלה, הפרת זכויות צד שלישי, או כל תוכן שהעלית.

12. שינויים בתנאים

נודיע על שינויים מהותיים בתנאים דרך האפליקציה ו/או בדוא"ל לפחות 30 יום מראש. המשך שימוש לאחר קבלת ההודעה מהווה הסכמה לתנאים המעודכנים. אם אינך מסכים — עליך להפסיק את השימוש ולמחוק את חשבונך.

13. התנתקות סעיפים

אם סעיף כלשהו בתנאים אלה יימצא בלתי תקף או לא ניתן לאכיפה, הוא ייפרד מהתנאים ויוחלף בסעיף תקף עם כוונה דומה — בעוד שאר התנאים יישארו בתוקף מלא.

14. דין חל ויישוב סכסוכים

תנאים אלה כפופים לחוקי מדינת ישראל. כל מחלוקת תידון בבתי המשפט המוסמכים במחוז תל אביב-יפו בלבד. הצדדים מתחייבים לנסות להגיע להסכמה ידידותית תוך 30 יום טרם פנייה לבית משפט.

Terms of Service — Calmino

1. Acceptance of Terms

By downloading, installing, or using the Calmino application ("the App" / "the Service"), you agree to these Terms of Service ("the Terms"). If you do not agree, discontinue use immediately and delete the app.

These Terms constitute a binding legal agreement between you and Calmino. Using the app confirms that you have read, understood, and agree to all Terms outlined below.

2. Service Description

Calmino is a baby and child health tracking application that enables:

• Tracking feeding, sleep, diapers, nutritional supplements, vaccinations, and medications
• Measuring growth metrics and growth curves
• Sharing data with family members
• Creating statistics, reports, and insights
• Recording magic moments and milestones
• Managing customized reminders and notifications

Minimum age for use: 16. The service is not intended for users under the age of 16.

3. User Account

• Registration: You must provide truthful, accurate, and current information.
• Security: You are responsible for maintaining the confidentiality of your password and login credentials. Notify us immediately of any unauthorized use.
• Single Account: Each person may hold only one personal account.
• Responsibility: You are solely responsible for all activity conducted through your account.
• Deletion: You may delete your account at any time through the Settings screen.

4. Permitted and Prohibited Use

Permitted:

• Personal and family use for managing care of your children
• Sharing data with family members you have authorized

Strictly prohibited:

• Commercial use without a written license from us
• Uploading illegal, offensive, misleading, or rights-infringing content
• Attempting to access other users' data without authorization
• Reverse engineering, disassembly, or code duplication of the app
• Use of bots, scripts, or automated tools
• Distribution of spam, malware, or malicious content
• Use for stalking, harassment, or violating others' privacy

5. User Content

Information you enter into the app (photos, notes, records) remains yours. By uploading it, you grant us a limited, non-exclusive license to store, back up, and display it solely for the purpose of providing the service.

You warrant that content you upload: does not infringe copyright or intellectual property rights; is not illegal, offensive, or misleading; and does not contain sensitive information of others without their consent.

6. Premium Service

• Calmino offers paid subscription plans ("Premium") with enhanced features.
• Payments are processed through Apple App Store or Google Play Store only — Calmino does not hold your credit card details.
• Subscriptions renew automatically at the end of each period; you may cancel at any time through store settings.
• No refunds will be issued for periods during which the service was used, unless required by law.
• We reserve the right to change pricing with 30 days advance notice.

7. Third-Party Services

The app relies on external services:

• Google Firebase - Data storage, authentication, and infrastructure
• Apple - Authentication and push notifications
• Expo - Development platform and updates
• RevenueCat - Subscription and purchase management
• Apple WeatherKit - Weather data

Your use of these services is also subject to their respective policies and terms of service. Calmino is not responsible for the availability, performance, or changes in third-party services.

8. Limitation of Liability and Medical Disclaimer

• The service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind.
• The app does not replace professional medical advice. The information displayed is for documentation and tracking purposes only. Always consult a qualified pediatrician for any medical questions.
• Calmino is not liable for direct, indirect, incidental, special, punitive, or consequential damages arising from use or inability to use the service.
• Our total liability shall not exceed the amount you paid in the last year of subscription, or ₪200 — whichever is less.

9. Intellectual Property

All rights in the app — including source code, design, user interface, logo, the name "Calmino", and all content we created — are the exclusive property of Calmino and are protected by copyright, trademark, and patent laws.

Strictly prohibited: duplication, distribution, modification, creation of derivatives, public display, or commercial use — without express written permission. Violation will result in civil and/or criminal action.

10. Account Termination and Suspension

We reserve the right to suspend or close accounts that violate the Terms, with prior notice where possible. For voluntary closure: you may export your data before final deletion using the "Download My Data" button in Settings.

11. Indemnification

You agree to indemnify and hold harmless Calmino, its employees, directors, shareholders, and partners from any claim, damage, liability, loss, cost, and legal fees arising from: your use of the service; violation of these Terms; infringement of third-party rights; or any content you uploaded.

12. Changes to Terms

We will notify you of material changes to the Terms via the app and/or email at least 30 days in advance. Continued use after receiving notice constitutes acceptance of the updated Terms. If you do not agree — you must discontinue use and delete your account.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, it shall be severed from the Terms and replaced with a valid provision with similar intent — while the remaining Terms shall remain in full force and effect.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Israel. Any dispute shall be heard in the competent courts in the Tel Aviv-Jaffa district only. The parties commit to attempting to reach an amicable resolution within 30 days before filing a court action.
